6.3. If You assert a patent infringement claim against Participant
    alleging that the Participant Software directly or indirectly
    infringes any patent where such claim is resolved (such as by
    license or settlement) prior to the initiation of patent
    infringement litigation, then the reasonable value of the licenses
    granted by such Participant under Sections 2.1 or 2.2 shall be taken

Contributor must: a) promptly notify the Commercial Contributor in
writing of such claim, and b) allow the Commercial Contributor to control,
and cooperate with the Commercial Contributor in, the defense and any
related settlement negotiations. The Indemnified Contributor may
participate in any such claim at its own expense.

For example, a Contributor might include the Program in a commercial
